Terms of Service

These terms govern access to and use of PastDue by business customers and their authorized users.

Using PastDue

PastDue provides software for collection agencies, debt buyers, servicers, and related business users. You may use the service only on behalf of an organization that has authorized you to access its workspace.

If your organization has a separate signed agreement or order form with PastDue, that agreement controls if it conflicts with these terms.

Accounts and workspaces

You are responsible for keeping your login credentials secure and for activity that occurs under your account. Workspace administrators are responsible for inviting users, assigning roles, disabling access when needed, and maintaining accurate company information.

PastDue may refuse, suspend, or terminate access if we believe an account is unauthorized, insecure, violates these terms, or creates risk for the service or others.

Customer data

Customers retain ownership of the debtor, account, portfolio, contact, document, payment, and activity data they submit to PastDue. You grant PastDue permission to host, process, transmit, display, and back up customer data as needed to provide and improve the service.

You are responsible for the accuracy, legality, and authorization of customer data submitted to PastDue, including any personal information, financial information, account records, and collection notes.

Compliance responsibilities

PastDue includes tools for workflows, audit trails, consent records, call windows, status tracking, documents, reports, and account activity. These tools do not replace your obligation to understand and comply with laws and rules that apply to your organization.

You are responsible for your collection practices, contact strategies, disclosures, scripts, notices, record retention, user permissions, and use of imported data. PastDue does not provide legal advice.

Acceptable use

You may not use PastDue to violate law, infringe rights, submit malicious code, attempt unauthorized access, interfere with the service, reverse engineer the platform, bypass security controls, or use the service to contact people without appropriate authorization.

You may not upload data that you are not authorized to process or use PastDue in a way that could harm consumers, customers, PastDue, or third parties.

Fees and subscriptions

Paid subscriptions, usage limits, billing terms, renewal terms, and taxes are governed by the applicable order form, invoice, checkout flow, or written agreement. Fees are generally non-refundable except as required by law or stated in a separate agreement.

Service changes and availability

We may modify, improve, suspend, or discontinue parts of PastDue over time. We work to keep the service reliable, but we do not guarantee that it will be uninterrupted, error-free, or available at all times.

Features labeled beta, preview, experimental, or similar may change or be removed and may be subject to additional limits.

Confidentiality and security

Each party may receive non-public information from the other. The receiving party must use reasonable care to protect confidential information and may use it only to perform under these terms or a related agreement.

PastDue uses safeguards designed to protect the service, but you remain responsible for secure user management, careful data imports, appropriate permissions, and prompt notice if you believe an account has been compromised.

Intellectual property

PastDue and its software, designs, workflows, documentation, and related materials are owned by PastDue or its licensors. These terms do not transfer ownership of the platform or any PastDue intellectual property.

Feedback or suggestions may be used by PastDue without restriction or obligation.

Disclaimers and limits

PastDue is provided as a software service. To the fullest extent permitted by law, we disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, PastDue will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption.

Changes and contact

We may update these terms as the service changes. If changes are material, we will provide notice through the service, by email, or by updating this page.
